This case concerns the prestigious Britannia development on Grand Cayman. I represent the strata corporations of Lions Court, Regents Court and Kings Court (comprising over 170 residences between them) and the residents of 18 individual villas, who have rights registered at the Cayman Islands Land Registry over the adjoining golf course and nearby beach club.
Subsidiaries of a large development corporation (Dart), which have bought the land on which those facilities stand, brought a case arguing that those rights are not legally valid and should be removed from the Land Register.
A leading Cayman Islands law firm representing most of the affected residents, Walkers, retained me as leading counsel for their defence of this claim.
After a 6 day trial in November/December 2020, in a 184 page judgment Mr Justice Segal found in favour of the validity of my clients’ rights, and his final order directed the Registrar of Lands to rectify the exact wording of the entries protecting them in the Land Register so as to spell out more fully their exact legal nature.
The plaintiffs have appealed against this decision, and their appeal is listed to be heard by the Cayman Islands Court of Appeal in May 2022.
